What is to be a responsible Pension Fund? An institutional approach of the duty of prudence.

American pension funds, and more generally employee benefits schemes, are financial devices designed to provide for social benefits. Because of this purpose, their investment policies are influenced by several logics. Although they have been managed by financial professionals (asset managers) since the 1960s they are still largely controlled by employers. They are not directly supervised by securities laws and the SEC but by a federal statute (ERISA) and the Department of Labor since the 1970s. Last but not least, they have inherited certain form of economic organization from the Trust.
I analyse this plurality of influences by developing an institutional approach which mixes historical, legal and socio-economic studies. Firstly, considering pension funds as an institution, I focus on their legal form, the Trust, and analyse its protective tradition. Secondly, I recount the history of pension funds in the XXth century and I wonder how their altered features have borrowed from this tradition. Thirdly, I recount the recent history of the prudent investment standard since the 1970s.
